‘The first of the attacks in the sequence with which the defendant is charged was to occur during the night of Sunday, 11 October 1992, when the defendant was to burgle [the home in Shirley] and to rape the occupier. … A’s sister died in August 1992, so shortly before the burglary, and from that point the victim lived alone at the address. She was then 89 years old: she died in 2005.
‘At about 21.15 on the Sunday night of the attack, Miss A felt tired and she prepared for bed. She washed, and then put on her pyjamas and she got into bed at about 21.45 where she read. Miss A heard a slight knocking sound at about this time but thought no more of it: she was living next to a main road and sounds like that were not unusual. The victim could not sleep immediately so, at about 22.30, she made herself a cup of coffee, before going back to bed shortly after 22.30 where she began to read again.
‘A few minutes later, Miss A noticed that the door to her bedroom was being opened slowly and a man appeared in the doorway. Entry had been gained to the address by a kitchen window to the rear of the premises. She said, “What are you doing here?” and he moved quickly to her, covering her mouth with a gloved hand. Her attacker – this defendant as the forensic evidence many years later was to establish – was dressed in a grey pullover, a dark jacket and dark trousers and he was wearing a balaclava. He shouted at her to be quiet. Miss A asked, ‘“What do you want – money?” and she got out of bed and gave the defendant what she had in her purse, £25 in cash. The defendant then said, “They told me that you had a lot of money.” In fact, Miss A had a safe, the key to which she had hidden between the mattresses on her bed.
‘The defendant then looked out of the window, presumably to check that the coast was clear, before removing the bulbs from the light in both the bedroom and the hallway. Having walked around the bedroom, picking up and looking at letters and papers, he turned his attention to the victim who by this point was sitting on the edge of the bed.
‘He bent down, put his hands to her face so as to hold it still and then pressed his mouth to Miss A’s in an attempt to kiss her. She shouted out, “Stop it please, you’re hurting me!” but he continued to press his lips to hers and then he tried to force his tongue into the old lady’s mouth. Next, the defendant forced the victim’s legs apart and, pressing down on her, he then raped her. He continued to hold Miss A’s face, pressing so hard that her false teeth were dislodged.
